CreatorAgent Terms of Service
These terms govern access to and use of CreatorAgent and its creator-brand communication and collaboration tools.
1. Acceptance of terms
By accessing or using CreatorAgent, you agree to these Terms of Service with Austin Taylor, the operator of CreatorAgent. If you use the service for a business or other entity, you represent that you have authority to bind that entity. If you do not agree, do not use the service.
2. Description of CreatorAgent
CreatorAgent is software for content creators who manage brand communications and collaboration workflows. Features include a Gmail-connected inbox, rule-based opportunity organization, creator preferences, manual and configurable automated email replies, conversation review, supported collaboration agreements and electronic signatures, Stripe-powered payment workflows, payout onboarding, and supported campaign and shipping workflows. Features may be experimental, test-account-limited, configuration-dependent, or unavailable to some users.
3. Account eligibility
You must be at least 18 years old, be legally able to agree to these terms, provide accurate account information, and use the service in compliance with applicable law. Access may initially be limited to approved test accounts. You must own or have authority to connect each Google account you authorize.
4. Google account authorization
Connecting Gmail requires you to authorize CreatorAgent through Google OAuth. You control whether to grant access and may revoke it through Google Account connections. Revoking authorization is separate from deleting data previously stored by CreatorAgent. You are responsible for maintaining control of your Google account.
5. Gmail communication and automated replies
CreatorAgent supports email reply tools. Manual replies are sent from the connected Gmail account after a user action. Where enabled by the operator’s deployment configuration, eligible messages may receive template-based automated replies without separate approval for each message. The implementation may restrict automated replies by recipient allowlists, start dates, daily limits, and rules that pause conversations with negotiation signals.
You are responsible for the accuracy and appropriateness of the preferences, rates, templates, and other information you configure. Automated replies will not be appropriate for every conversation. Review communications and all commercial commitments carefully, and monitor the connected account for errors or unexpected results.
6. Brand collaborations
Creators and brands are responsible for evaluating opportunities, making lawful disclosures, communicating accurately, and performing their agreements. CreatorAgent does not guarantee sponsorships, campaign acceptance, product delivery, sales, audience results, or earnings. CreatorAgent is not an agent, talent manager, employer, or representative of either party merely because the service supports a workflow.
7. Collaboration agreements
Supported features may prepare collaboration terms covering compensation, deliverables, deadlines, content usage, and other campaign expectations and may collect electronic signatures. Each party is responsible for reviewing the final terms, confirming signer authority, and obtaining professional advice where needed. CreatorAgent does not guarantee that a generated or electronically signed agreement is complete, suitable, or enforceable in every jurisdiction.
8. Payment services
Stripe provides payment processing, Checkout, refunds, and connected-account payout onboarding for supported workflows. Stripe’s terms and verification requirements also apply. CreatorAgent is not a bank or licensed escrow service. The service code contains configuration-dependent payment, refund, transfer, offer-expiration, and ledger functions; these terms do not promise a platform fee, payment release date, refund outcome, chargeback result, or payout timing.
9. Creator responsibilities
You are responsible for providing accurate information; safeguarding access to your accounts and devices; reviewing templates and messages; communicating lawfully; making required advertising and sponsorship disclosures; complying with platform, tax, consumer-protection, intellectual-property, privacy, and marketing laws; and performing the deliverables you accept.
10. Acceptable use
You may not use CreatorAgent to commit fraud; send spam or unlawful messages; impersonate others; access data without authorization; mislead creators, brands, or customers; introduce malicious code; interfere with the service; evade access restrictions or security controls; scrape or probe the service without authorization; infringe rights; or engage in unlawful, abusive, or deceptive conduct.
11. Third-party integrations
Google, Cloudflare, Stripe, USPS, Geoapify, and other integrated providers operate under their own terms and privacy policies. CreatorAgent does not control those services and is not responsible for third-party changes, outages, account restrictions, or decisions.
12. Service availability
We may add, modify, limit, suspend, or discontinue features and integrations. We do not guarantee uninterrupted, error-free, or permanently available service. Beta, experimental, and account-limited features may change without notice. Scheduled synchronization and external API behavior depend on third-party systems.
13. Intellectual property
CreatorAgent and its software, interface, branding, and documentation are owned by the operator or its licensors and are protected by applicable intellectual-property laws. Subject to these terms, you receive a limited, revocable, non-exclusive, non-transferable right to use the service.
You retain rights in content and information you provide. You grant the operator a limited license to host, process, reproduce, display, transmit, and otherwise use that content only as reasonably necessary to operate, secure, and improve the user-facing service and comply with law. Collaboration agreements may separately grant rights between creators and brands; those rights are governed by the applicable agreement.
14. Disclaimers
To the maximum extent permitted by law, CreatorAgent is provided “as is” and “as available.” The operator disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. CreatorAgent does not provide legal, tax, financial, or business advice. You should independently review communications, agreements, payments, disclosures, and campaign obligations.
15. Limitation of liability
To the maximum extent permitted by law, the operator and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the service.
To the maximum extent permitted by law, total liability arising out of or relating to the service will not exceed the greater of $100 or the fees you paid directly to CreatorAgent during the 12 months before the event giving rise to the claim. This limit does not apply to liability that cannot lawfully be limited.
16. Termination
You may stop using the service and revoke Google access at any time. We may suspend or terminate access for security risk, unlawful or harmful use, breach of these terms, third-party requirements, or discontinuation of the service. Logging out only ends the current session and does not delete stored records. To delete eligible account data, use the authenticated account-deletion control or contact support as described in the Privacy Policy. Certain contractual and payment records may be retained for legitimate legal, accounting, security, or dispute purposes.
17. Modifications
We may change the service or these terms. We will update the effective date and provide notice when required. Continued use after changes take effect constitutes acceptance where permitted by law.
18. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. They do not require arbitration or waive participation in a class action. Subject to applicable law, disputes may be brought in courts with jurisdiction in Florida.
